About Us

Web Business Builders provides website design in WordPress and Elementor, branding and identity work, WooCommerce store setup, digital marketing and SEO, and website care and maintenance, primarily for U.S. small businesses. We are based in Pompano Beach, Florida, USA.

Use of the Site

You agree to use the Site only for lawful purposes, and specifically agree not to attempt unauthorized access to the Site, our servers, or any connected systems, not to introduce malware or interfere with the Site’s normal operation, not to scrape, copy, or republish Site content without permission, and not to impersonate any person or misrepresent your affiliation with anyone.

Intellectual Property

All content on the Site, including its text, graphics, logos, images, and underlying design and code, is owned by Web Business Builders or used with permission, and is protected by copyright and trademark law; you may not reproduce or redistribute it without our written consent. Client websites and brand work shown in our portfolio, case studies, and testimonials are displayed with each client’s permission. Once a project is paid in full, ownership of the final deliverables created specifically for you, such as the website or logo files, transfers to you, with the exception of any third-party licensed assets like stock photos, plugins, or fonts, which remain subject to their own license terms. Until final payment is received, all deliverables remain the property of Web Business Builders.

Quotes, Proposals & Service Agreements

Nothing on the Site constitutes an offer capable of acceptance or a binding contract on its own. A service relationship begins only once both parties have signed a proposal, quote, or service agreement setting out the scope, price, and timeline of the work.

Payment Terms

Projects are generally billed on a fixed-price basis as set out in your service agreement, often with a deposit due before work begins and the balance due at agreed milestones or upon completion, while ongoing services such as care and maintenance plans are billed on a recurring basis as described in your chosen plan. Payments are processed through our third-party payment processor, and we do not store your full card or bank account details. Late payments may pause active work until the account is brought current. Because the specific deposit percentages and late-fee terms are a financial decision rather than a legal one, we recommend Brian and Leigh confirm the exact figures before this section is published.

Revisions & Change Requests

Each service agreement includes a defined number of revision rounds. Requests that go beyond the agreed scope, such as new pages, new features, or a different design direction after approval, may be treated as a change order and quoted separately.

Project Timelines

We aim to deliver quickly, and our productized process is built for speed, but published timelines such as “days, not months” are general estimates rather than guarantees. Actual delivery depends on factors including how promptly you provide feedback, how quickly you deliver content and assets such as copy, images, and account logins, and the complexity of your specific project.

Third-Party Platforms & Ongoing Costs

Our work typically relies on third-party platforms and services, including WordPress, Elementor Pro, WooCommerce, web hosting, domain registration, plugins, and payment gateways. Unless a cost is explicitly included in your service agreement or a maintenance plan, ongoing licensing, hosting, domain, and transaction fees for these third parties remain the client’s responsibility.

Cancellations & Refunds

This section is a placeholder pending an explicit decision from Brian and Leigh before it is published, but a common structure used by other productized agencies is as follows. Deposits are generally non-refundable once work has begun, since they cover time and resources already committed. If a project is cancelled partway through, work completed to that point will be invoiced, or a pro-rated refund of unused fees may be issued at our discretion based on the work already delivered. Recurring maintenance plans can typically be cancelled with advance notice before the next billing cycle, with the exact notice period to be confirmed.

No Guarantee of Business Results

We build websites and marketing assets designed to help your business grow, but we cannot guarantee specific outcomes such as search engine rankings, traffic, lead volume, or sales, since these depend on many factors outside our control, including market conditions, your industry, your own follow-through on marketing, and changes to third-party platforms or algorithms. Statistics and testimonials shown on the Site describe individual past results and are not promises of similar results for you.

Warranties & Disclaimers

The Site and our services are provided “as is.” Except as expressly stated in your service agreement, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

Limitation of Liability

To the maximum extent permitted by law, Web Business Builders’ total liability for any claim arising from the Site or our services will not exceed the amount you actually paid us for the specific service giving rise to the claim, and we are not liable for indirect, incidental, or consequential damages such as lost profits or lost business opportunities.

Indemnification

You agree to indemnify and hold Web Business Builders harmless from claims, damages, or expenses, including reasonable legal fees, arising from your misuse of the Site, your breach of these Terms, or content or materials you provide us that infringe a third party’s rights.

Newsletter & Marketing Communications

If you subscribe to our newsletter, we will send periodic emails in line with the CAN-SPAM Act, including our physical mailing address and a working unsubscribe link in every commercial email, and you may unsubscribe at any time.

Governing Law & Disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles, and any dispute arising from these Terms or our services will be resolved in the state or federal courts located in Florida, unless your signed service agreement specifies otherwise. This should be confirmed as the correct state of formation or principal place of business before publishing.

Termination

We may suspend or terminate access to the Site for anyone who violates these Terms, and either party may terminate an active service agreement according to the terms specified in that agreement.

Changes to These Terms

We may update these Terms from time to time, and continued use of the Site after changes are posted means you accept the updated Terms. The “Last Updated” date above reflects the most current version.
